Srinagar, Aug 6: The hearing in the case seeking abrogation of Article 35(A) has been adjourned because the bench was incomplete as one of them could not attend the court, reports reaching from Delhi said.
The case was listed before a three-judge bench headed by the Chief Justice. Apart from Chief JusticeJustice Dipak Misra, the two members of the bench include Justice Ajay Manikrao Khanwilkar and Justice Dhananjaya Yashwant Chandrachud. It was the latter member who could not attend the court as a result of which the case was deferred till August 27.
The two members of the bench were of the opinion that the case must go to the constitutional bench.
The hearing has pushed Jammu and Kashmir to the edge. Most of the state is on a strike since Sunday and the issue has reduced the gap between politics’ ideological divide.
Reports said the state government had suggested that since the state is planning Panchayat elections, the case should be adjourned.
An NDTV report said the bench told the petitioners that while they have waited for fifty years on the 35A, why can not they want for two weeks more.
